The Courts in North Carolina may order payment of private school tuition in some cases. The North Carolina Child Support Guidelines adjust for private school if considered an extraordinary expense. Also, you can ask that the court deviate from the guidelines to require a parent who has been paying for private tuition to continue to do so. It is more difficult to convince the court to provide for private education if the child is not currently enrolled in private school, unless the child has a particular individual need that cannot be provided for in public school. Some parents agree to include a provision in the court order for payment of such tuition because both parents believe it is important for their child.
If you want your spouse to share this expense for your child, then talk it over with your lawyer. So, be sure to provide your attorney with information regarding tuition, fees, and other expenses related to private education.
