I need health insurance. Can I still be covered under my spouse’s insurance plan after we are divorced?
During your separation, depending on the specific terms of the policy, your spouse may choose to maintain you on the health insurance policy. However, after the divorce is complete, most insurance companies will no longer consider you to be a relative of the policy holder. As such, most insurance companies will not permit your spouse to keep you on his/her health insurance once your divorce has been finalized.
Speak with your divorce attorney to determine your options regarding health insurance. If you are unable to obtain health insurance, provisions may be made during the divorce settlement to ensure access to healthcare.
