While you cannot make your former spouse cover the cost of your own health insurance, having him cover the cost can be a negotiating point when attempting to amicably resolve issues of on-going spousal support, or can be a factor in a spousal support award in court. If you are the dependent spouse and are unable to meet your reasonable needs and expenses (under which health insurance would fall), you may be entitled to receive spousal support. Your ability to receive spousal support will be based upon a number of factors, but most importantly on whether or not your spouse has the ability to pay after meeting his reasonable needs and expenses.
