Work with your attorney and your spouse to reach a temporary agreement on who will pay the debts. Discuss the importance of making at least minimum payments on time. You will want to do this to avoid substantial finance charges and late fees. These issues may be resolved by the court. The court may issue a temporary spousal support award or use an interim distribution of marital property and/ or debts.
Usually, the spouse who remains in the home will be responsible for the mortgage payments, taxes, utilities, and most other ordinary expenses related to the house. Sometimes the mortgage will be apportioned between the parties. It may also be addressed in the spousal support order. If you are concerned that you cannot afford to stay in the marital home on a temporary basis, talk with your attorney about your options prior to your temporary hearing.
