My spouse asked if he could switch weekends. I tried to be nice and said ok, but now he is constantly wants to change around his time with the kids. Can I make him stick to the custody schedule now when I haven’t been consistent in the past?
The short answer is – it depends. There are a number of factors that will affect your options such as, the length of time the schedule has been in place and how frequently you have permitted changes to the schedule. If you have a child custody order in place with the court, you have a greater ability to force your spouse to stick to the terms of the order. Visitation schedules in a Separation Agreements can also enforced, but the process is different from court orders and not always as effective. However, if the custody schedule is an informal calendar that you and your spouse have created together, it may be more difficult to enforce the schedule. Keep in mind that frequently making changes to a custody schedule could have unintended consequences, including a modification of child support. You should schedule a consultation with one of our experienced family law attorneys to discuss your options.
