Decisions regarding health care for a child are vested with the parent that has been granted primary legal custody. Legal custody is different than physical custody in that it pertains to the ability to make major decisions regarding the well-being of your child. If there is a custody order in place, the decision regarding ADHD medication for your child depends on which parent, if any, has been awarded primary legal custody. If the Order does not specify, or if there is no custody order in place, either parent can make this decision.
